1. Introduction

Welcome to American Outdoor Living ("we," "us," "our," "AOL" for short). These Terms of Service ("Terms") govern your use of our website americanoutdoorliving.net ("Website") and the provision of landscaping construction, landscaping maintenance, and related services (collectively, "Services") by American Outdoor Living. By accessing or using the Website or engaging our Services, you agree to be bound by these Terms.

2. Services

We provide landscaping construction (such as hardscapes, outdoor living spaces, patios, fire features) and landscaping maintenance (such as lawn care, plant care, irrigation maintenance, seasonal cleanup) to clients in the areas we serve. Our Services may be customized per client. Any written or verbal estimates, proposals, work orders, invoices or contracts we provide are subject to these Terms and any additional service-contract terms.

3. Client Obligations

You agree to provide accurate, current and complete information needed for us to perform the Services, including site access, utility locations, and other relevant matters.

You agree to ensure safe access to the property for our personnel, obtain any required permits, and comply with local laws and regulations unless otherwise agreed in writing.

You agree to pay all invoices in full, in accordance with the payment terms set out in your proposal, estimate or contract.

4. Scheduling and SMS/Communications

We will communicate with you (including via SMS/text messages, phone calls and email) to schedule Services, provide pre-visit alerts (e.g., "we are headed out to your property"), update you about ongoing issues, current problems or potential future issues (e.g., irrigation leaks, plant health problems) as part of our maintenance or construction Services.

By providing your mobile phone number and/or subscribing to our SMS service, you consent to receive text message alerts from us. Message and data rates may apply. You may opt out of SMS communications at any time by replying "STOP" or contacting us at barmend@americanoutdoorliving.net.

We reserve the right to change our communication methods, but will always provide you with opt-out instructions.

5. Estimates, Contracts and Changes to Work

We will provide you with a written estimate or contract for Services when required. The estimate will set forth the scope of work, materials, schedule, payment terms and any warranties (if applicable).

If you request changes after the estimate has been accepted or the contract executed (a "Change Order"), we will issue a revised estimate or written change order reflecting the changes and any cost or schedule adjustments.

We are not responsible for delays or cost increases caused by factors beyond our control (weather, natural disasters, acts of third-parties, permit delays, hidden site conditions, etc.).

6. Payment, Fees and Late Payment

Payment terms (due dates, deposit, progress payments, final payment) will be set forth in the estimate or contract.

If payment is not received when due, we may charge interest or late fees, suspend Services, or retain rights to property materials until payment is made.

Unless otherwise agreed in writing, you remain responsible for full payment even if you request or cause suspension or termination of Services.

7. Warranties and Disclaimers

We warrant that we will perform the Services in a workmanlike manner consistent with industry standards. Any specific warranty for materials or labor will be set forth in the contract or manufacturer documentation.

Disclaimer: Except as expressly provided in your written contract, we make no other warranties (express or implied), including warranties of merchantability or fitness for a particular purpose.

We are not responsible for natural wear and tear, damage caused by acts of nature, vandalism, misuse, or lack of client maintenance unless otherwise agreed.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability to you under these Terms or any contract is limited to the total amount you paid us for the specific Service giving rise to the claim.

We will not be liable for any special, indirect, incidental, punitive or consequential damages (including loss of profit or business interruption) even if we have been advised of the possibility of such damages.

Some states may not allow exclusion or limitation of certain damages; so these limitations may not apply in full to you.

9. Term, Termination and Suspension

Either party may terminate a contract for Services in accordance with the cancellation or termination provision set forth in that contract.

We may suspend Services or refuse to perform further work if you fail to honor payment obligations, fail to provide access or requisite information, or otherwise materially breach your obligations.

10. Intellectual Property

The Website, its design, text, graphics, logos, images, audio and video (collectively, "Content") are owned or licensed by us and are protected by copyright, trademark and other laws.

You may view and print materials from the Website solely for your personal, non-commercial use. No other use is permitted without our express written consent.

11. Privacy and Data Collection

By using our Website or Services, you agree to our collection, use and sharing of your information as described in our Privacy Policy.

You agree that we may send you service-related communications (including SMS/text alerts) as permitted under applicable law.

12. Governing Law and Dispute Resolution

These Terms and any contract shall be governed by the laws of the state of Nevada without regard to its conflicts of law rules.

Any dispute arising out of or related to these Terms, the Website or our Services shall be resolved by binding arbitration in Las Vegas, Nevada under the rules of the American Arbitration Association. You and we each waive any right to a jury trial or to participate in a class-action lawsuit, to the extent permitted by applicable law.
